It is a legally accepted act of creating civil paternity between two persons by transferring a parent’s legal rights and duties to another person. In this context, all the parental rights and responsibilities are transferred from the biological parents of the child to the adoptive parents.
Both the adopting parents and the biological parents must have mutual understanding or shall have consent for adoption.
Legally, domestic adoption means to accept other people’s children of Nepali as their own children by the adopter being Nepali citizen only. It is the legal process of adopting a child who is a permanent citizen or resident of Nepal by a Nepali adopter.
In case of Nepal, for adoption, one must file an application in the concerned District Court mentioning the reasons for adoption along with the details of the individual to be adopted.
Childless couple can file application if they want to adopt. However, any person who has children but files a petition at the concerned District Court to adopt a child and proves that his financial capability to arrange for the overall maintenance of the child, the Court can grab permit upon inquiry of the capability.
